Understanding Your Employment Contract Before You Fly

Your employment contract is the legal foundation of your entire time abroad. It defines your salary, hours, benefits and protections, and it is your strongest tool if a dispute arises. Yet many workers sign without fully reading it, or sign a second, different contract on arrival. Understanding the document before you travel is essential.

Here is what to look for, clause by clause, and why the contract you sign in Nepal must match the one you sign at your destination.

Key Clauses to Check

Salary and Payment Terms

Check that the basic salary, currency and payment date are clearly stated. Understand what is "basic" versus allowances, because benefits such as end-of-service gratuity are often calculated on the basic figure alone.

Working Hours and Overtime

The contract should state the standard working day, the weekly rest day, and the rate paid for overtime and work on public holidays. Verbal promises about overtime mean nothing unless they appear in writing.

Accommodation, Food and Transport

  • Is accommodation provided, and to what standard?
  • Are meals included or is a food allowance paid?
  • Who pays for transport between accommodation and the worksite?
  • Who covers your flight home at the end of the contract?

Contract Duration and Termination

Note the length of the contract, the probation period, and the notice required from both sides. Be cautious of clauses that impose heavy penalties if you resign early.

A common abuse is to show one contract in Nepal and present a worse one on arrival. Always keep a signed copy of your approved contract and refuse to sign a replacement that reduces the terms you agreed to.
